Waiver and Release of Liability for Visitors of Diyanet Center of America Hamam & Spa Facility
I, the undersigned visitor of Diyanet Center of America Hamam & Spa Facility, hereby acknowledge the following:
1. Acknowledgment of Islamic Guidelines & Modesty Code
I acknowledge that the Hamam & Spa Facility operates under the guidelines of Diyanet Center of America ("DCA"), a non-profit religious organization that promotes an environment of Islamic ethics, modesty, and family-friendly values. Accordingly, I agree to: (a) wear modest swimwear that covers the 'awrah (private areas) appropriately as per Islamic tradition; and (b) refrain from any public displays of affection while on the premises. I acknowledge that this is a strict alcohol, drug, and smoke-free facility and that any violation of this policy will result in immediate removal from the facility without refund.
2. Assumption of Risk
I, the undersigned, acknowledge that the use of a Hamam, sauna, steam room, and related wet facilities ("Activities") involves inherent risks and dangers of serious bodily injury, including, without limitation: Burns, heat exhaustion, heat stroke; dizziness, fainting, loss or consciousness; slips, trips and falls on wet surfaces; exacerbation of pre-existing medical conditions; dangers to pregnancy or cardiovascular conditions; permanent disability, paralysis and death ("Risks"). I also acknowledge that these Risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the Activities or the negligence of the Releasees named below. I further acknowledge that there may be other risks and losses either not known to me or not readily foreseeable at this time. I fully accept and assume all risks of losses, costs and damages, whether or not they are now known or foreseeable, I incur as a result of my participation in the Activities to the extent that the losses, costs and/or damages are the result, whether directly, indirectly or otherwise, of the actual or alleged negligence of any one or more of the Releasees.
In addition, I understand that massage therapy and "kese" treatment (deep exfoliation massage) are provided for stress reduction, relaxation, and relief of muscular tension, and they are not a substitute for medical examination, diagnosis, or treatment. I knowingly and voluntarily assume all risks associated with massage therapy and/or the "kese" treatment provided at DCA's Hamam & Spa Facility, including temporary muscle soreness, skin irritation, or allergic reactions to oils and lotions. I also understand that the "kese" treatment involves vigorous physical friction and exfoliation, which may cause temporary skin redness, tingling, or mild sensitivity.
3. Medical Conditions & Physician Consultation
I certify that I (or my child) am physically fit to use the heated facilities and to participate in the Activities. I understand it is my responsibility to consult with a physician regarding my fitness to participate in the Activities if I have any health condition and/or take any medication. I also acknowledge that individuals with medical conditions (including heart disease, high/low blood pressure, diabetes, or epilepsy) or who are pregnant should not use the heated facilities (sauna, steam room, Hamam). I also understand the importance of hydration and agree to drink plenty of water before, during, and after use.
4. Compliance with Facility Rules and Etiquette
I agree to abide by all posted rules and guidelines of DCA's Hamam & Spa Facility, including but not limited to:
- Hygiene: Showering before use; using a towel to sit on to maintain hygiene; wearing spa slippers at all times.
- Safety: Limiting time in heated areas to a maximum of 15 minutes; avoiding use after eating; cooling down gradually before exiting.
- Prohibited Items: No external skincare products, glass bottles, razors, sharp items, food, or drinks inside the wet facility.
- Technology & Privacy: No photos or videos in locker rooms or facility areas. Cellphones must be left in designated GSM boxes or lockers.
- Noise: Maintaining a respectful level of noise and refraining from phone use.
5. Release of Liability
In consideration of being allowed to use and participate in Activities at DCA's Hamam & Spa Facility, I hereby release and discharge, and covenant not to sue, Diyanet Center of America, its members, managers, agents, officers and employees (the "Releasees"), from/for any and all liability, claims, demands, losses or damages caused or allegedly caused in whole or in part by the negligence of any of the Releasees, and waive any liability of, or any claim I may have against, any Releasee as a result, in whole or in part, of the negligence of any of the Releasees. I further agree that if, despite this release, waiver of liability, assumption of risk, and indemnity agreement, anyone on my behalf makes a claim against any of the Releasees based upon the negligence or alleged negligence of any one or more Releasees, I will indemnify and hold harmless each of the Releasees from any expense of litigation, attorney fees, loss, liability, damage, or cost.
6. Personal Property
I acknowledge that DCA is not liable for any lost, stolen, or damaged personal property.
7. In Case of Emergency
In the event of an emergency, I authorize the DCA staff to provide or obtain emergency medical treatment for me (or my child) if deemed necessary. I agree to be responsible for all costs associated with such treatment.
I have fully informed myself of the contents of this Waiver and Release of Liability by reading it before signing it. By my signature below, I understand and agree to the above terms and conditions.
For Parents/Guardians of Participant of Minor Age (Under Age 18 at Time of Registration)
As the parent/guardian with legal responsibility for the minor child whose name is stated above, I accept and agree to the full contents of this Waiver and Release of Liability in consideration of him/her being permitted to use DCA's Hamam & Spa Facility. I agree to release, indemnify, defend and hold DCA harmless from all liabilities and future claims presented by my minor child and/or his/her parents, for any losses suffered by him/her. This includes any claim of the minor and any claim arising from the negligence of DCA.
